This page provides general information regarding statutory consumer guarantee rights for products purchased through www.placeholder.com.
1. Statutory Legal Guarantee
New goods sold to consumers are covered by the statutory legal guarantee of conformity provided by applicable Italian and European Union consumer law.
The statutory legal guarantee generally applies for a period of two years from delivery.
This legal guarantee is provided by Moxma as the seller and exists independently of any additional commercial or manufacturer warranty.
2. What the Legal Guarantee Covers
The legal guarantee applies where a product does not conform to the sales contract under applicable consumer law.
It does not generally cover defects or damage arising after delivery from causes attributable to the Customer, including:
- accidental damage;
- improper use or handling;
- normal wear and tear;
- liquid or impact damage;
- unauthorised modifications or repairs;
- improper maintenance; or
- other damage not resulting from an original lack of conformity.
3. Remedies
Where a valid lack of conformity exists, the Customer is entitled to the remedies provided by applicable consumer law.
These generally include repair or replacement as the primary remedies, subject to the statutory rules concerning impossibility and disproportionate cost.
Where the applicable legal requirements are met, the Customer may instead be entitled to an appropriate price reduction or termination of the sales contract.
4. Manufacturer Warranty
Some products may additionally benefit from a commercial warranty offered by the manufacturer.
Manufacturer warranties are separate from the statutory legal guarantee and may vary depending on the manufacturer, product model, country of origin, intended market or country in which warranty service is requested.
Unless expressly stated on the relevant product page, Moxma does not guarantee that a particular manufacturer warranty or manufacturer service programme is available for a product in a particular country.
Any absence or limitation of a manufacturer warranty does not remove statutory consumer rights against Moxma.
5. Manufacturer and Authorised Service
Where appropriate, Customer Service may recommend or arrange diagnosis or service through the manufacturer or an authorised service provider.
Such referral may provide a faster technical solution but does not remove any statutory responsibility that Moxma has as the seller.
6. Making a Warranty Claim
If you believe that a product is defective or does not conform to the sales contract, please contact our Help Center or:
We may request information reasonably necessary to identify and assess the issue, including:
- your order number;
- the product concerned;
- the IMEI or serial number;
- a description of the reported defect;
- photographs or videos where relevant; and
- diagnostic information where reasonably necessary.
Where physical inspection is required, Customer Service will provide further return or service instructions.
7. Withdrawal Rights
The statutory legal guarantee is separate from the 14-day right of withdrawal.
Expiry of the withdrawal period does not affect a Customer's legal guarantee rights for a qualifying lack of conformity.
